IMPORTANT - Please Read Carefully

The following terms and conditions cover all aspects of trade, products, services or their combination between the Customer, the Product Provider, the Service Provider, or their combination (hereinafter "customer", "you", "your", "yours") and Gold Terra Enterprises Inc./ATOPMEX (hereinafter "ATOPMEX”, “we”, “us” or “our”). By visiting our website, using our services/products, and/or providing your services/products to us, you agree to all these terms and conditions.

Nothing contained within these standard terms and conditions affects your statutory rights as a consumer, or our statutory rights as a consumer

The Gold Terra Enterprises Inc./ATOPMEX cannot be held responsible for any incorrect information provided by the Customer, the Product Provider, the Service Provider, or their combination that may affect the normal processing and delivery of goods and services.

1. Definitions:

Agreement - means Legal Binding Enforceable Agreement, your order received by us and incorporates by reference these Terms and Conditions of Sale.

Applicable Law - the statutes, rules, regulations, and any other law of every kind and nature as adopted and/or amended in any applicable jurisdiction from time to time.

Binding Contract - means Legal Binding Enforceable Contract, any contract and/or agreement for products, services, or combination of both that is/are provided to Gold Terra Enterprises Inc./ATOPMEX by the Customer, the Product Provider, the Service Provider or their combination.

Bullion Product -  the minted commodity of pure rare, precious or noble metal that ATOPMEX shall now or may hereafter offer for sale to buyers in its ordinary course of business. "New" bullion refers to newly minted, current year and uncirculated products, although these may exhibit scratches, dents, tarnish or other blemishes obtained during or after the minting process.  "Used" bullion refers to current or non-current year products which may exhibit scratches, dents, tarnish or other blemishes.  The value of bullion products is unaffected by physical condition.

Business Days - work days of Monday through Friday, excluding weekends and federal holidays.

Cancellation fee - the FIFTY dollar ($50.00) administrative charge added by us to every order where you have not complied with the requirements for payment as set out in Section 5 of this Agreement. This cancellation fee is in addition to any other funds owed to us by you, including but not limited to those funds pursuant to Section 6 and 7.

Carrier - the relevant company delivering your order(s). The carrier may be Canada Post, FedEx, or such other carrier as may be used by us from time to time.

Clearing time - the time period from when your payment in full is received by us into our designated bank account, and when such payment can be verified. The duration of this clearing time is determined based on the method of payment used by you and may be amended from time to time at our discretion.

Credit card information - the credit card number, expiry date, CSV and the name on the relevant credit card supplied by you.

Customer - will refer to someone (individual or business) who enters into a purchase or a sale transaction with ATOPMEX.

FINTRAC - the Financial Transactions Reports Analysis Centre of Canada.

Liquidation - the conversion of your bullion product(s) to cash, and is undertaken by us in the event of a voluntary liquidation (Buy-Back) or an involuntary liquidation of your order.

Locked-in - will refer to the time a purchase or sale transaction is confirmed and the price is fixed. The price, calculated based on the spot price at the time of the transaction is locked-in regardless of market fluctuations.

Market Value - the value of a certain bullion product as determined by the trading of same on certain markets and as acceptable to us in our sole discretion at a particular time and date.

Method of Payment - those methods we make available to you to pay us for your order, as may subject to certain terms and conditions and may be changed at our sole discretion from time to time.

NSF - Non-Sufficient Funds and occurs when payments are made to ATOPMEX without adequate funds in the account which the instrument is drawing on.

Online Store - refers to the ATOPMEX online gold, silver, platinum and palladium store found at www.atopmex.com

Order - your verbal or electronic request to us for a certain quantity of a certain bullion product for a certain price at a particular time and date as agreed to by us in our sole discretion.

Product Provider and/or Service Provider - will refer to someone (individual or business) who provides Gold Terra Enterprises Inc./ATOPMEX with its products and/or services.

Refunds and/or Chargebacks - refers to any refund and/or chargeback. Not allowed by Gold Terra Enterprises Inc./ATOPMEX. Only repurchases are allowed.

Rejected payment - refers to payments retracted after having been submitted to ATOPMEX. This can include, but is not limited to, cancelling; checks, bill payments and credit card payments.

Seller or Trader - refers to Gold Terra Enterprises Inc./ATOPMEX, and its directors, and employees (hereinafter "ATOPMEX”, “we”, “us” or “our”) that are authorized to deal in transaction.

2. Bullion Market Price and Availability Change Constantly

The parties hereto agree that the bullion products we offer for sale are commodities traded on various markets, and that the market price and availability of such bullion change constantly in accordance with market forces and supply and demand. We reserve the sole and absolute discretion to set the sale and buy-back prices for all products and bullion offered by us.

3. Agreement

Placement of order creates Legal Binding Enforceable Agreement between you (individual or business), as the Customer, and ATOPMEX.

4. Binding Contract

Any contract and/or agreement by Customer, Product Provider, Service Provider or their combination to provide ATOPMEX with products and/or services creates Legal Binding Enforceable Contract. Shall such Binding Contract fail to be fulfilled and/or create obstacles for a normal course of business to ATOPMEX, it can be considered voided by ATOPMEX at our sole discretion. All expenses, charges, fees, or their combination that would be related to the termination of such Binding Contract are subject to be reimbursed to ATOPMEX by Customer, Product Provider, Service Provider or their combination; or to be withheld from a payback amount that is owed by ATOPMEX to Customer, Product Provider, Service Provider or their combination.

5. Payment Processing

You agree to provide your credit card information to secure and lock in the purchase price of your order:

  • for the orders of $500.00 or less your credit card will be charged $10.00, for the orders of more than $500.00 your credit card will be charged $85.00. The charge will be subtracted from the final purchase price of your order at NO ADDITIONAL FEE to you. Your credit card will not be charged for the amount of your purchase, unless you made a choice to pay by credit card.

You agree to follow ALL instructions that are provided by us in Payment Options.

By completing our online order process, you agree for the ATOPMEX to debit your provided payment method using our secure server.

Orders placed using a credit or debit card through our payment gateway will be delivered to the registered cardholder's address only. An alternative delivery address will only be accepted for orders placed using check or bank transfer upon receipt of cleared funds to our nominated bank account.

All payments must be made in USD, CA dollars, Bitcoins or any other currency, as indicated on your order checkout page.

NSF/Stopped Payment Statement Customers are asked to contact the ATOPMEX office. All NSF and Stopped Payments, initiated by the buyer are subjects to $25.00 charge to the Customer account as an administration and processing fee. The ATOPMEX reserves the right to refuse or withhold orders of any transactions that fail our security checking and antifraud tests. If it is deemed questionable or of significant risk to ATOPMEX regardless of payment method and price confirmation and in such case, you waive any right to any claim or actual damages of any kind or nature whatsoever.

The full payment or the remaining balance due must be dated within 24 hours of your Sale Order or your Sale Order is subject to cancelation by ATOPMEX.

Upon our receipt of your payment, in full, we will hold your payment and your bullion product(s) ordered for the clearing time applicable to the method of payment(s) used by you. Once your payment has been cleared into our designated bank account and verified, and upon expiration of the relevant clearing time, your order will be released for shipment to you.

International Customers acknowledge that the customs office of the destination country may apply customs fees, import duties, taxes and other charges in accordance with that country’s applicable tax law. Any such surcharges will be the responsibility of the Customer and not that of ATOPMEX.

6. Order Validity

Once you have placed your order, either over the phone or through the online store, we will endeavor to send you a confirmation and/or an invoice by email for the placed order. Our failure to send and/or your failure to receive either or both, does NOT invalidate or otherwise cancel your order with us; you are still required to pay for your order.

You agree to take all steps necessary, including but not limited to updating any address books and/or adjusting spam or junk-mail filters, to ensure that you can receive emails from us in a timely manner, complete with any attachments, in furtherance of this Agreement.

7. Right to Cancel/Liquidation/Voluntary Liquidation. No Refund (Exchange only) Policy

Gold, Silver, Platinum and Palladium products are exempt from cancellation because, the price is dependent on fluctuations in the financial markets which cannot be controlled by Trader. Once you’ve placed your order, we do NOT allow any cancellations by you before you have paid in full for your order. No Refunds and/or Chargebacks are allowed. However, ATOPMEX would be happy to re-purchase your goods at our current buy back rate; generally 2-5% below the current market value. If, Cancellation and/or any type of Liquidation happens, then all expenses, charges, fees, or their combination that may incur shall be subtracted by ATOPMEX from a payback amount. Although, No Refunds are allowed, but if any product to be found defective without any sign of tampering with it, such a product can be exchanged for a same product or its equivalent.

8. Non-Payment/Unpaid Order/Involuntary Liquidation

In the event of non-payment of the balance due, ATOPMEX reserves the right to cancel orders at its sole discretion and the buyer will be subject to a 5% restocking fee. All cancelled orders are subject to a 5% restocking fees and actual market differential fees. The value difference will be determined by the change in the underlying gold, silver, platinum or palladium price from the time of the order to the time of the cancellation. Collectible coins/items will be charged the difference in the ask price of the item from the time of sale to the price at the time of cancellation.

9. Multiple Orders

If, you have placed more than one order with us and have paid for one or more of the order(s), but also fail to pay for one or more of such order(s) in accordance with Section 3 hereof, any shipment of the paid order(s) may be held at our discretion until payment in full is received for all orders and applicable cancellation fee(s). At our sole discretion, we may elect to apply the money received by us for your paid order(s) and/or the bullion product(s) comprising your paid order(s) against any payment(s) due and owing to us on account of your unpaid order(s). If, after exercise of any such election(s) by us, you still owe us any amount, we may, in our sole discretion, involuntarily liquidate any remaining product(s) in the quantity required by us, acting reasonably, in order to ensure that we are paid in full for all your orders and applicable cancellation fee(s).

Where, after all your unpaid order(s) and applicable cancellation fee(s) are paid to us, any of your order(s) or portions thereof remain due and owing to you, you may elect to receive shipment of such order(s) or portions thereof so remaining, or to receive payment in the amount of the marker value for same, refunded by check.

ATOPMEX reserves the right to employ the services of a collection agency should cancellation fees remain unpaid for a period exceeding 90 days.

10. Pre-orders

Customers should be aware that the value of their investment may change between pre-order and delivery. Any adverse movement in the metal price will not entitle the customer to a full or partial refund.

11. Shipping, Duties, Fees, and Tariffs

Your order will be shipped to you within 1-2 business days from when we received payment in full, unless the clearing time applicable. Orders are sent by registered and insured mail and can take up to 5-10 business days in average to receive. All orders with Shipping Adjustment status will be shipped within 15-21 business days from when we received payment in full, unless the clearing time applicable. If we unable to comply with the above mentioned shipment time we will notify you as soon as reasonably possible. Upon receipt of such notice, you may:

  • accept the new shipment time (new time shall not exceed 30 days)
  • request Voluntary Liquidation according with Section 5.

If we unable to ship your order within the new shipment time, then after this new time has passed, we will return your payment.

Computation of Time Period. Unless otherwise expressly stated herein, the first day for computing any applicable time period shall be the first business day following the placement of the relevant order. If the last day of the time period falls on a day other than a business day, then the last day of a time period shall be the next business day thereafter.

Shipping Methods:

All orders will be mailed by using FedEx, Canada Post, UPS or USPS. All packages shipped by ATOPMEX require a signature upon delivery and/or pick up. You agree not to accept the delivery without inspecting your delivered package for subject of any openings and/or damages. It is your sole responsibility, to inspect the package for any openings and/or damages. Responsibility of ATOPMEX is waived, once the package is delivered to you, and you signed for it accepting the delivery.

ATOPMEX fully insures all shipments. Our insurer is liable if anything should happen to your package while it is in transit. However, ATOPMEX cannot accept responsibility if:

  • You have a signature waiver on file with the courier company
  • You have your purchase delivered to a non-residential (or alternative) address
  • Your package is signed for by a third party

International (Non-Canadian) Customers: It is sole customer's responsibility to find out and to be liable for any duties, fees or tariffs in any country where the delivery of order is made. Customer is fully responsible to comply with all laws and/or requirements of the country where the order delivery is made. Responsibility of ATOPMEX is waived, if the Order is delivered to you, but you cannot receive it due to any issue with your country's customs or any other official authorities. ATOPMEX denies any responsibility and cannot be held liable, for any non-received order, should it happen due to any issues with your country's official authorities.

12. Reservation of Rights

In addition to the rights contained in this Agreement, we reserve the following rights unto ourselves, to be exercised in our sole and absolute discretion:

Right to Accept or Reject Any Late or Defective Payment. We reserve the right to:

  • accept any late or otherwise deficient payment including but not limited to liquidation payments; and/or
  • reject any late or otherwise deficient payment, including but not limited to liquidation payment,
  • at any time in our sole and absolute discretion.

Right to Be Reimbursed and/or to Withhold Funds. We reserve the right to be reimbursed for any losses and expenses, if such are happened in relation to failed Order and/or Binding Contract; and/or to withhold funds from a payback amount that is owed by us to Customer, Product Provider, Service Provider or their combination.

Right to Cancel Any Binding Contract. We reserve the right to cancel any Binding Contract, shall such Binding Contract fail to be fulfilled and/or create obstacles for a normal course of business to us, or to our security.

Right to Cancel Any Order. We reserve the right to cancel any order at any time for any reason. If we exercise this right, we will cancel your order, including the shipment of same, and we will notify you and refund to you all monies you may have paid to us pursuant to such order, less any costs and/or fees associated with cancelling your order, as may be applicable.

Right to Change Terms and Conditions of Sale. We reserve the right to change any terms and conditions of sale at any time without any prior notice.

Right to Correct Errors in Orders. We reserve the right to correct any typographical or clerical errors or omissions in any order. We will make a good faith effort to notify you of any such corrections to your order.

Right to Hold Funds and Shipments to comply with FINTRAC and the law

  •  If you are, or if you appear to be, sending to us multiple payments or other payment(s) that, in our sole discretion, may require us to report such payment(s) to FINTRAC or take other steps in order to comply with applicable law, we reserve the right to hold any and all such payments and to withhold shipment of the related order(s) in our sole discretion until you provide us with all the information as we may require, to our sole satisfaction, in order to comply with FINTRAC and/or applicable law.
  • We hereby reserve the right to involuntarily liquidate, cancel and/or rescind any order where we are unable to obtain and/or to verify any information required by us.

Right to Hold Payment. We reserve the right to hold any payment until it is verified and cleared and/or the customer has communicated with us and submitted a valid Credit Card on all first time orders. This is done solely in the interest of fraud prevention and all holds are removed promptly upon the completion of the above conditions.

Right to Meet Supply & Demand. We reserve the right to meet Supply & Demand economic law of the market. We reserve the right that quantity and intensity of our orders can excess our ability to supply. If we are unable to supply any placed order, the refund or the equal amount substitute exchange as per our choice will be provided.

Right to Record Any Audio and Video Calls. We reserve the right to record any audio and video calls at our sole discretion. Considering the monetary nature and the value of the products we sell, we have to use high security measures. Therefore, any calls may be recorded for quality improvement of our customer service and/or for security reasons.

Right to Refuse Service to Anyone. We reserve the right to refuse service to anyone.

Right to Require Payment by Bank Wire Transfer. We reserve the right to require any payment by bank wire transfer.

Right to Waive Any Responsibility in Cases of Force Majeure Curcumstances and/or Acts of God. We reserve the right to waive any responsibility, legal or any other, in cases of force majeure circumstances - circumstances which are beyond our means of control or influence; and in cases of acts of God.
